A sub-inspector, not the Greater Noida executive magistrate, was suspended for violating the Supreme Court’s order by serving show-cause notice to a student for his alleged campaign seeking participation in a protest by the Cockroach Janta Party, The Indian Express reported on Friday.

The clarification from the Uttar Pradesh Police came hours after reports widely quoted Solicitor General Tushar Mehta, representing the state, as having informed the Supreme Court that the executive magistrate had been suspended.

The notice had asked the 20-year-old law student, Akshat Tripathi, to furnish a personal bond of Rs 5 lakh.

The student at the Gautam Buddh University had challenged the magistrate’s notice, which was issued after a police report alleged that he was instigating other students to participate in a proposed protest.

The notice stated that Tripathi was “spreading anti-government, misleading statements among other university students and provoking them”, which could “disrupt public peace”.

Tripathi had said that he had not been going to the university for the past three months.

“I was working at the Allahabad High Court in July,” he said. “How could I go to the university and provoke people?”

The notice was withdrawn the following day after the allegations were investigated.

On Wednesday, a lawyer verbally mentioned the matter before a bench headed by Chief Justice Surya Kant.
